Returns and right of withdrawal

RIGHT OF WITHDRAWAL AND RETURNS

Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Consumer (as defined in Article 3 paragraph 1) may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) days from the date of receipt of the products.

In order to exercise the right of withdrawal referred to in the preceding article, the Consumer must send Monica Zuccheri a notice to that effect, within the terms indicated, to the following email address info@monicazuccheri.it

Once given notice as above, the Consumer will receive an authorization code, which must be written on the package, and must re-send the products to Monica Zuccheri within 14 (fourteen) days of the same withdrawal, to the following address:

The cost of return shipping will be borne by the Customer himself, who may use the courier of his choice.

For orders over € 75.00 delivered within the Italian territory, exclusively in the event that the Customer requests a refund of the return by issuing a value coupon or requests a replacement item of equal or greater value at the same time as the return (possibly integrating the difference in cost through one of the payment methods offered by the platform), the return shipment will be free of charge, and will be carried out through the resofacile procedure described below, without any charge. Each order has the opportunity to take advantage of the free return only once, whether all the items in the order or a part of them are returned.

Under no circumstances may the right of withdrawal be exercised by refusing delivery of the order. Refusing a delivery does not entitle you to a refund.

For the Italian territory only, there is the resofacile service that provides home pickup of the package containing the return. The cost of the service is € 10.00 and will be subsequently deducted from the refund, so that the customer will not have to anticipate anything.

In order to take advantage of the return-easy service, the Consumer must give written notice at least 48 hours before the day requested for pickup.
The pickup must be made at a constantly manned address, which may be different from the delivery address, and which must be clearly indicated in the service activation request.

Please note that failure to collect due to the sender's absence at the address will result in a deduction of €20.00 from the refund.

CHRISTMAS SEASON RETURN EXTENSION

Without prejudice to the deadline of 14 days set, for the Christmas period, all orders delivered from December 1 until December 11 inclusive are granted the right to request the return of the goods until the deadline of December 31.
Availing of this right, the refund will take place exclusively through the issuance of a voucher equal to the value of the returned goods, net of additional expenses for delivery services and payment incurred during delivery.
Shipping costs shall be borne by the Consumer and the general conditions mentioned below shall apply.
The voucher issued must be spent within one year of issuance exclusively at www.monicazuccheri.it, in one lump sum, cannot be refunded under any circumstances, does not entitle to change.

TERMS AND CONDITIONS

In order for the Consumer to be eligible for a refund, the return must meet the following conditions:

- Goods must be returned undamaged, using if possible the packaging in which they were delivered, or one of equal strength, sealed with tape on all openings.

- A label should be affixed with the sender's data, shipping address. Alternatively, the required data can be handwritten on the package using an indelible marker.

- Goods must be complete with all parts and in their original packaging (envelopes, boxes, dustbags and wrappings), with tags still attached.

- All items must be returned together with their original box, where present, which is considered to all intents and purposes an integral part of the product itself and must not have been damaged and/or altered in any way, and cannot be used as the only outer packaging.

- The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, accessories, etc. ...);

- Shipment, until the certificate of receipt at the warehouse indicated by Monica Zuccheri, is the complete responsibility of the customer;

- If the goods are damaged during transport, Zuccheri Monica will promptly notify the Customer, to enable him to file a complaint against the carrier of his choice and obtain a refund; the product will then be made available to the Customer, at the same time canceling the request for withdrawal;

- Monica Zuccheri will not be liable in any way for damage, theft, loss occurring during or otherwise in dependence of the return shipment.

- Any free gifts received for promotions or otherwise must be returned at the time you decide to get a refund.

- Returns will not be accepted for custom or made-to-order items.

Monica Zuccheri will refund the Consumer the full amount of the returned items, within 10 (ten) days from the receipt of the withdrawal shipment, by means of a reversal procedure of the amount charged, using the same means of payment used by the Consumer for the initial transaction, unless otherwise agreed. In case of payment by bank transfer, the customer must notify Monica Zuccheri of the IBAN code to which to make the refund. In any case, the Consumer will not incur any cost as a consequence of said refund. Monica Zuccheri may suspend the refund until receipt of the returned product or until the Consumer proves that he/she has correctly returned the product.
In any case, the Consumer will forfeit the right of withdrawal in cases where Monica Zuccheri ascertains that:

- The return shipment has not been previously authorized by Monica Zuccheri;

- The returned product and/or its accessories, and/or its packaging are not intact;

- The product is missing its original outer packaging and/or inner packaging;

- The product is missing integral elements of the same and/or accessories (e.g., fasteners, laces, buckles, etc.).

In the event of forfeiture of the right of withdrawal, Monica Zuccheri will return the purchased product to the sender, charging the sender the shipping costs and, where already refunded, the price of the product.

RETURNS FOR LACK OF CONFORMITY

In compliance with the obligations arising from D. Lgs 206/2005 concerning conformity defects, the Consumer may exercise his right in the following ways:
Send written notice to Monica Zuccheri at Email: info@monicazuccheri.it within 14 days from the appearance of the defect attaching to the notice the copy of the purchase invoice or order confirmation. The period of validity for the warranty right is 14 days for final Consumers only, while it is limited to only one year for items purchased not by final Consumers (companies/professionals) as enshrined in the above-mentioned Legislative Decree.
The Consumer following the communication may receive a request for photographic documentation for an initial assessment.
The Consumer will have to send to Pelletterie Monica Zuccheri Via Veneto N. Chiavari (GE) ITALY the article presenting the defect, using an adequate packaging to protect its contents, sealing with adhesive tape all openings.
The package must have a label showing the sender's data, the shipping address. Alternatively, you can handwrite the required data using an indelible marker.
The costs for the return to Monica Zuccheri are borne by the Consumer, who may use a courier of his choice.
Once the package is received, the procedure for verification of the defect complained of will be activated.
At the end of the verification procedure, if a lack of conformity has indeed been found, the customer will receive at no cost the item duly repaired, or replacement with a new item if available, or a refund of the price paid.
In the event that no lack of conformity is found, or the wear and tear conditions of the item make it impossible to determine whether or not it is a lack of conformity, the item will remain available at our warehouse to be collected by the customer. It is understood that 12 months after the item has been made available for collection, it is to be considered abandoned if the customer has not picked it up, then it will be disposed of and nothing will be due.
