GENERAL CONDITIONS OF SALE

ARTICLE 1 - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT

The contract entered into between Monica Zuccheri and the Customer shall be deemed concluded with the acceptance, even partial, of the order by Monica Zuccheri. In the event of non-acceptance of the order, Monica Zuccheri will in any case promptly notify the Customer.
By placing an order in the various ways provided, according to the order form on the Site (hereinafter the "Order"), the Customer declares that he/she has read all the information provided to him/her during the purchase process and accepts in full, without reservation, these general conditions (hereinafter the "Conditions").

These Conditions may be printed or saved on a durable medium, in accordance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

ARTICLE 2 - METHOD OF PURCHASE

The products offered for sale by Monica Zuccheri are only those on the site monicazuccheri.it at the time of placing the Order, as described in the relevant information sheets.
Once the order request has been received, Monica Zuccheri reserves the right to reconfirm the availability of the items purchased, the validity of the transaction by credit card. In the event that the items ordered are not available, or if for some reason the order could not be processed as per the Client's request, Monica Zuccheri will promptly notify the Client.
In order to place an Order, the Client must fill in all parts of the relevant form on the Site and submit it after carefully reviewing the Conditions, as well as the characteristics of the product and/or products he/she intends to purchase. The Customer must also request Monica Zuccheri, if desired, the issuance of a tax invoice relating to the purchase, pursuant to art. 22 D.p.R. n. 633/1972.
The Customer holder of VAT number (not qualifying as a consumer) who makes an order will automatically forfeit the right of withdrawal and the right to warranty, as provided by the Consumer Code, will be limited to twelve months from the date of purchase of the product.

The correct receipt of the Order is confirmed by Monica Zuccheri by means of an e-mail reply, sent to the e-mail address communicated by the Customer. This confirmation message will summarize the conditions of purchase, as required by applicable law, as well as the data entered in the Order by the Customer, so that the same can verify them and, if necessary, communicate without delay the necessary corrections of incorrect data.

ARTICLE 3 - PRICES AND TERMS OF PAYMENT

The prices indicated on the site are to be considered inclusive of the taxes and duties applicable in the country of invoicing. Any shipping costs or payment charges are in any case communicated in advance to the Customer through the site or these Conditions. It should be noted that separate shipping and billing addresses may be given as long as they are within the same country. All orders that violate this condition will be cancelled.
The prices indicated on the site are in Euros. If conversion to currencies other than the euro is indicated, it will be purely indicative and not binding for the conclusion of the purchase contract.
The following payment methods are provided: payment on delivery.

PayPal
For the payment can be used by the customer the Paypal circuit according to the specific modalities of the same
Credit Card
In cases of purchase of goods with mode of payment Credit Card, the transaction may take place through the Paypal secure server or other secure server chosen by Monica Zuccheri. Under no circumstances and at no stage of the payment Monica Zuccheri will be able to know the information relating to the Customer's credit card, transmitted via secure connection directly to the site of the banking institution handling the transaction. No computer file of Monica Zuccheri will retain such data and therefore in no case Monica Zuccheri can be held responsible for any fraudulent and improper use of credit cards by third parties at the time of payment
Transfer
In case of purchase by transfer, the bank details for payment will be displayed. The shipment of the goods will take place only upon actual receipt of payment in the bank.

ARTICLE 4 - PRIVACY

The personal data collected by placing the Order will be processed by Monica Zuccheri for the sole purpose of satisfying the express requests of the Customer, in accordance with Legislative Decree 196/2003 and subsequent regulatory changes and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Customer.

ARTICLE 5 - APPLICABLE LAW

The contract of sale referred to in these Conditions and the execution thereof and governed by Italian Law, with the disapplication of the rules of conflict and the United Nations Convention for the International Sale of Goods. The Court of Genoa shall have jurisdiction for the resolution of related disputes.

ARTICLE 6 - COPYRIGHT

Trademark, logo and other distinctive signs on the site belong to Monica Zuccheri. Use of the trademark, logo and other distinctive signs including reproduction on other websites by unauthorized third parties is prohibited. The contents of the site are protected by copyright (text, images and graphics).

ARTICLE 7 - AGREEMENT

The contract supersedes all previous contracts, agreements, and understandings between the parties and constitutes the entire agreement between the parties regarding the subject matter of the contract, together with the order, the general conditions relating to the use of the site, and the conditions relating to the registration service. Any change or modification of the contract must be accepted in writing by both parties.

ARTICLE 8 - COMMUNICATIONS

All communications between the parties shall be in writing and sent to the address of the other party indicated in the contract and order. Communications sent to the other party's e-mail address indicated on the site and in the order shall also be deemed to have been sent in writing.

ARTICLE 9 - INTERNATIONAL SHIPMENTS

The site is visible and accessible from all over the world, however shipping is possible, but the Customer will bear the shipping costs.

ARTICLE 10 - REQUIREMENTS FOR PURCHASE

To complete a purchase on the monicazuccheri.co.uk website, the Customer must meet the following requirements:

Be at least 18 years old.
Possess the necessary requirements to enter into legally binding contracts.
Have a valid E-mail address.
Possess a valid credit card for payment: Visa, MasterCard, American Express or a Verified PayPal account or bank account.

RIGHT OF WITHDRAWAL AND RETURNS

Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Consumer (as defined in Article 3 paragraph 1) may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) days from the date of receipt of the products.

In order to exercise the right of withdrawal referred to in the preceding article, the Consumer must send Monica Zuccheri a notice to that effect, within the terms indicated, to the following email address info@monicazuccheri.it

Once given notice as above, the Consumer will receive an authorization code, which must be written on the package, and must re-send the products to Monica Zuccheri within 14 (fourteen) days of the same withdrawal, to the following address:

The cost of return shipping will be borne by the Customer himself, who may use the courier of his choice.

For orders over € 75.00 delivered within the Italian territory, exclusively in the event that the Customer requests a refund of the return by issuing a value coupon or requests a replacement item of equal or greater value at the same time as the return (possibly integrating the difference in cost through one of the payment methods offered by the platform), the return shipment will be free of charge, and will be carried out through the resofacile procedure described below, without any charge. Each order has the opportunity to take advantage of the free return only once, whether all the items in the order or a part of them are returned.

Under no circumstances may the right of withdrawal be exercised by refusing delivery of the order. Refusing a delivery does not entitle you to a refund.

For the Italian territory only, there is the resofacile service that provides home pickup of the package containing the return. The cost of the service is € 10.00 and will be subsequently deducted from the refund, so that the customer will not have to anticipate anything.

In order to take advantage of the return-easy service, the Consumer must give written notice at least 48 hours before the day requested for pickup.
The pickup must be made at a constantly manned address, which may be different from the delivery address, and which must be clearly indicated in the service activation request.

Please note that failure to collect due to the sender's absence at the address will result in a deduction of €20.00 from the refund.

CHRISTMAS SEASON RETURN EXTENSION

Without prejudice to the deadline of 14 days set, for the Christmas period, all orders delivered from December 1 until December 11 inclusive are granted the right to request the return of the goods until the deadline of December 31.
Availing of this right, the refund will take place exclusively through the issuance of a voucher equal to the value of the returned goods, net of additional expenses for delivery services and payment incurred during delivery.
Shipping costs shall be borne by the Consumer and the general conditions mentioned below shall apply.
The voucher issued must be spent within one year of issuance exclusively at www.monicazuccheri.it, in one lump sum, cannot be refunded under any circumstances, does not entitle to change.

TERMS AND CONDITIONS

In order for the Consumer to be eligible for a refund, the return must meet the following conditions:

- Goods must be returned undamaged, using if possible the packaging in which they were delivered, or one of equal strength, sealed with tape on all openings.

- A label should be affixed with the sender's data, shipping address. Alternatively, the required data can be handwritten on the package using an indelible marker.

- Goods must be complete with all parts and in their original packaging (envelopes, boxes, dustbags and wrappings), with tags still attached.

- All items must be returned together with their original box, where present, which is considered to all intents and purposes an integral part of the product itself and must not have been damaged and/or altered in any way, and cannot be used as the only outer packaging.

- The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, accessories, etc. ...);

- Shipment, until the certificate of receipt at the warehouse indicated by Monica Zuccheri, is the complete responsibility of the customer;

- If the goods are damaged during transport, Zuccheri Monica will promptly notify the Customer, to enable him to file a complaint against the carrier of his choice and obtain a refund; the product will then be made available to the Customer, at the same time canceling the request for withdrawal;

- Monica Zuccheri will not be liable in any way for damage, theft, loss occurring during or otherwise in dependence of the return shipment.

- Any free gifts received for promotions or otherwise must be returned at the time you decide to get a refund.

- Returns will not be accepted for custom or made-to-order items.

Monica Zuccheri will refund the Consumer the full amount of the returned items, within 10 (ten) days from the receipt of the withdrawal shipment, by means of a reversal procedure of the amount charged, using the same means of payment used by the Consumer for the initial transaction, unless otherwise agreed. In case of payment by bank transfer, the customer must notify Monica Zuccheri of the IBAN code to which to make the refund. In any case, the Consumer will not incur any cost as a consequence of said refund. Monica Zuccheri may suspend the refund until receipt of the returned product or until the Consumer proves that he/she has correctly returned the product.
In any case, the Consumer will forfeit the right of withdrawal in cases where Monica Zuccheri ascertains that:

- The return shipment has not been previously authorized by Monica Zuccheri;

- The returned product and/or its accessories, and/or its packaging are not intact;

- The product is missing its original outer packaging and/or inner packaging;

- The product is missing integral elements of the same and/or accessories (e.g., fasteners, laces, buckles, etc.).

In the event of forfeiture of the right of withdrawal, Monica Zuccheri will return the purchased product to the sender, charging the sender the shipping costs and, where already refunded, the price of the product.

RETURNS FOR LACK OF CONFORMITY

In compliance with the obligations arising from D. Lgs 206/2005 concerning conformity defects, the Consumer may exercise his right in the following ways:
Send written notice to Monica Zuccheri at Email: info@monicazuccheri.it within 14 days from the appearance of the defect attaching to the notice the copy of the purchase invoice or order confirmation. The period of validity for the warranty right is 14 days for final Consumers only, while it is limited to only one year for items purchased not by final Consumers (companies/professionals) as enshrined in the above-mentioned Legislative Decree.
The Consumer following the communication may receive a request for photographic documentation for an initial assessment.
The Consumer will have to send to Pelletterie Monica Zuccheri Via Veneto N. Chiavari (GE) ITALY the article presenting the defect, using an adequate packaging to protect its contents, sealing with adhesive tape all openings.
The package must have a label showing the sender's data, the shipping address. Alternatively, you can handwrite the required data using an indelible marker.
The costs for the return to Monica Zuccheri are borne by the Consumer, who may use a courier of his choice.
Once the package is received, the procedure for verification of the defect complained of will be activated.
At the end of the verification procedure, if a lack of conformity has indeed been found, the customer will receive at no cost the item duly repaired, or replacement with a new item if available, or a refund of the price paid.
In the event that no lack of conformity is found, or the wear and tear conditions of the item make it impossible to determine whether or not it is a lack of conformity, the item will remain available at our warehouse to be collected by the customer. It is understood that 12 months after the item has been made available for collection, it is to be considered abandoned if the customer has not picked it up, then it will be disposed of and nothing will be due.

SHIPMENTS

The shipment will take place, once the order is confirmed, within the second working day following the confirmation (working day is to be understood as Monday to Friday, excluding holidays recognized by the Italian calendar).
Monica Zuccheri reserves the right to verify the validity of the transaction, even possibly by contacting the bank of the other party. In this case, the shipment of the goods will not take place until the verification procedure is successful.
The couriers currently used is GLS. The Customer does not have the right to choose the courier, which will be designated exclusively by Monica Zuccheri.
Shipment throughout the country to foreign countries (see permitted destinations) will take place with delivery in 6-10 working days (any customs procedures may increase the delivery time). Delivery times are approximate and based on the average delivery time of currently addressed couriers. Any delays in delivery will not entitle you to a full or partial refund of the purchased goods.
Before confirming the order, the cost for shipping will be indicated, which may vary depending on the country of destination and cannot be quantified in advance.

International Shipping:
We can ship virtually anywhere in the world. After entering the shipping address in the shopping cart, shipping times and costs will be visible.

All shipments are made in packages sealed with tape. The Customer is required, upon delivery, to check the integrity of the packaging and tape. In case of breakage or tampering of the packaging or adhesive tape, the Customer must affix the reserve to verify the contents to the courier before withdrawing the package.
In case of shortages or damaged items, promptly report, and no later than 48 hours after receipt of the shipment, to Monica Zuccheri in the manner provided for returns. Claims will not be accepted on shipments received by the Customer without reservation.
It is strongly recommended not to use blades or sharp objects to open the package, so as not to damage the items contained inside.
For shipments outside the European Union, any customs import charges will be borne by the Customer. Customs duties and possible taxes vary according to the country of destination and are applied upon arrival of the goods in that country: therefore, the Customer is invited to contact the customs authorities of his/her country in advance to verify the costs and possible import limits.
In case of rejection of the goods by the Customer or non-delivery for other reasons (e.g. wrong address and/or telephone number of the consignee; repeated absence of the consignee, etc.) the amount will be withheld to cover the following costs: sending goods + return of goods + cost of storage + customs for non-European shipments. The price of the goods net of withheld charges will be refunded.
